1. Introduction
Welcome to Soketra ("we," "us," "our"). These Terms & Conditions ("Terms") govern your access to and use of https://soketra.com/ (the "Site") and any purchase you make from us, including orders placed with Cash on Delivery (COD).
By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site. These Terms are governed by the laws of the United Republic of Tanzania, including the Electronic Transactions Act, 2015, the Fair Competition Act, 2003, and the Personal Data Protection Act, 2022.
2. Eligibility
You must be at least 18 years old, or placing an order under the supervision of a parent/guardian, to use this Site and make purchases.
3. Products and Pricing
- All products listed on the Site are described as accurately as possible, including images, specifications, and pricing, in line with our obligation to provide accurate and accessible product information.
- Prices are displayed in Tanzanian Shillings (TZS) unless otherwise stated and are inclusive of applicable taxes unless indicated otherwise.
- We reserve the right to correct pricing or product description errors at any time. If an error is discovered after you place an order, we will contact you before processing the order further.
- Product availability is not guaranteed until your order is confirmed. Out-of-stock items will be cancelled or refunded/adjusted as applicable.
4. Orders
- Placing an order on the Site constitutes an offer to purchase, which we may accept or decline.
- We may cancel or refuse any order at our discretion, including in cases of suspected fraud, repeated failed COD deliveries, incorrect pricing, or unavailability of stock.
- An order confirmation (via SMS, WhatsApp, email, or call) does not guarantee delivery until dispatch is confirmed.
5. Cash on Delivery (COD)
- COD is available for select locations and products, as indicated at checkout.
- Payment in full, in cash, is due to our delivery agent/courier at the time of delivery. Please have the exact amount ready where possible.
- We reserve the right to request order confirmation by phone call, SMS, or WhatsApp before dispatching COD orders, to reduce fraudulent or fake orders.
- Repeated refusal of COD orders without valid reason (e.g., damaged item, wrong item) may result in restrictions on future COD orders for that customer.
- Please inspect your item(s) at the point of delivery, where reasonably possible, before completing payment.
- Soketra is not responsible for cash payments made to individuals who do not represent our authorized courier/delivery partners. Always verify delivery personnel before making payment.
6. Delivery
- Estimated delivery timeframes are provided at checkout or via order confirmation and are not guaranteed, as they may be affected by location, courier availability, weather, or other circumstances beyond our control.
- Delivery is made to the address provided by the customer at checkout. Soketra is not liable for delayed or failed delivery resulting from incorrect or incomplete address/contact information provided by the customer.
- Risk of loss or damage to products passes to the customer upon successful delivery.
7. Returns, Refunds, and Cancellations
Returns, refunds, and cancellations are governed by our separate Return, Refund & Cancellation Policy, available at [soketra.com/returns], which forms part of these Terms.
8. Customer Responsibilities
You agree to:
- Provide accurate, complete, and current information when placing an order
- Be available (or have someone available) to receive delivery at the address and time provided
- Pay the full amount due at the time of COD delivery
- Not use the Site for any unlawful or fraudulent purpose, including placing fake orders
9. Intellectual Property
All content on the Site, including logos, text, graphics, images, and design, is the property of Soketra or its licensors and is protected under applicable Tanzanian intellectual property laws. You may not reproduce, distribute, or use our content without prior written permission.
10. Limitation of Liability
To the fullest extent permitted under Tanzanian law, Soketra shall not be liable for:
- Indirect, incidental, or consequential damages arising from use of the Site or products purchased
- Delays or failures in delivery caused by circumstances beyond our reasonable control
- Loss arising from incorrect information provided by the customer
Nothing in these Terms limits any rights you have under the Fair Competition Act, 2003, or other mandatory consumer protection laws of Tanzania that cannot be excluded.
11. Consumer Rights
In accordance with Tanzanian consumer protection law, you are entitled to:
- Accurate information about products before purchase
- Fair treatment free from misleading or deceptive trade practices
- The right to raise complaints with us directly, or escalate to the Fair Competition Commission (FCC) or other relevant authority if unresolved
12. Prohibited Uses
You may not use the Site to:
- Violate any applicable law or regulation
- Submit false or fraudulent orders
- Attempt to gain unauthorized access to our systems or data
- Infringe on the rights of Soketra or any third party
